1. Agreement

These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and Iron Concept doo, a private limited company registered in Montenegro, doing business as DXFForge ("we", "us", "our"). By visiting https://dxfforge.com (the "Site"), creating an account, joining our waitlist, or purchasing any product, you accept these Terms in full. If you do not accept them, please do not use the Site.

2. What we provide

DXFForge sells original digital design files in DXF, SVG, and related vector formats. The designs are intended for use with fiber laser cutters, CO2 laser cutters, plasma cutting machines, and CNC routers. All files are delivered as instant digital downloads after a successful payment.

We may release new designs, retire older ones, or change pricing at any time. Changes do not affect any purchase you have already completed.

3. Customer account

When you purchase a design or join the waitlist, we create a lightweight account tied to your email address. You are responsible for keeping your email account secure. We do not store passwords — access is granted via time-limited magic links sent to that email address.

We may suspend or terminate access if we have reasonable cause to believe the account has been used to violate these Terms, our License, or any applicable law.

4. Purchases & payment

All purchases are processed by a third-party Merchant of Record acting on our behalf. The Merchant of Record is the seller of record for tax, invoicing, and chargeback purposes. DXFForge never sees or stores your card details. By placing an order you authorise the Merchant of Record to charge the payment method you provide and to issue you the corresponding receipt.

Prices on the Site are quoted in US dollars and exclude any sales tax or VAT applicable in your country. The Merchant of Record will add the correct tax during checkout based on your billing location.

Orders are typically delivered within seconds of payment clearing. If you have not received your download link within 10 minutes, contact us at hello@dxfforge.com.

5. License granted to you

On successful payment, we grant you a non-exclusive, non-transferable, worldwide license to use the purchased file as described on our License page, which is incorporated into these Terms by reference. The license permits personal use and commercial use of finished cut pieces. It does not permit resale, sharing, or sub-licensing of the raw vector files.

6. Intellectual property

All designs sold on DXFForge are original work created in-house. DXFForge and Iron Concept doo retain all copyright, trademark, and other intellectual-property rights in the designs and the Site content. Nothing in these Terms transfers ownership of those rights to you.

If you believe any content on the Site infringes your copyright, please notify us at hello@dxfforge.com with the details required for a valid takedown notice. We respond within 5 business days.

7. Acceptable use

When using the Site or any purchased file, you agree NOT to:

• Resell, distribute, share, or sub-license the raw vector files.
• Upload the files to design marketplaces, file-sharing sites, AI training datasets, or stock libraries.
• Use the designs in any unlawful, infringing, defamatory, or hateful context.
• Reverse-engineer, scrape, or attempt to gain unauthorised access to any part of the Site.
• Interfere with the Site's operation (DoS, automated abuse, security probing).

8. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms. In summary: digital downloads are non-refundable once delivered, but we will replace any file that is corrupted, materially different from the preview, or otherwise demonstrably faulty.

9. Disclaimers

The Site and the files are provided "as is" and "as available". While we test our designs on real cutting machines and aim to match all preview images, we make no warranty that any file will run flawlessly on every machine, software version, or material. Cutting parameters (power, speed, kerf, feed rate) are the responsibility of the operator.

To the maximum extent permitted by applicable law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with your use of the Site or any purchased file is limited to the amount you paid for the file (or, in the case of the Full Access Bundle, the amount paid for the Bundle) in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of materials cut, or damage to machinery, however caused and on any theory of liability. This limitation does not exclude liability that cannot be excluded under applicable law.

11. Indemnification

You agree to indemnify and hold us harmless from any claim, demand, loss, or damage (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party right in connection with your use of the Site or any purchased file.

12. Termination

We may suspend or terminate your access to the Site or to purchased files if you breach these Terms or the License. On termination, the license granted to you ends and you must stop using and delete all copies of the purchased files. Sections that by their nature should survive termination (IP, liability, indemnification, governing law) survive.

13. Governing law & disputes

These Terms are governed by the laws of Montenegro, without regard to its conflict-of-laws rules. Any dispute arising out of or in connection with these Terms shall be submitted to the competent court in Podgorica, Montenegro, unless mandatory local consumer-protection law of your country of residence requires a different forum.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be announced on this page with a new "Last updated" date. Continued use of the Site after changes constitutes acceptance. If you do not accept a change, your sole remedy is to stop using the Site.
